These terms govern every quote, delivery and related service that APEX Technology GmbH, Brunner Straße 63, Obj. 21, 1230 Wien, Austria ("we", "us", trading as Service Pack LCD) provides to business customers in connection with the catalogue at servicepacklcd.net.
1. Scope and business customers only
We sell exclusively to entrepreneurs within the meaning of § 1 UGB and § 1 KSchG: repair shops, service centres, resellers and distributors. By requesting a quote or placing an order you confirm that you act in the course of your business. Consumer protection rules do not apply. Purchasing terms of the buyer are not part of the contract even if we do not expressly reject them.
2. The catalogue is not an offer
Product pages on servicepacklcd.net are a catalogue. Orders are placed by enquiry and quote; the listing itself is an invitation to request a quote, not an offer. A listing does not guarantee that the part is in stock at a given moment or in a given quantity. Stock levels, colours and packaging variants are confirmed individually.
3. Quotes, orders and conclusion of contract
- Our quotes are non-binding (freibleibend) unless they state a fixed validity period.
- A purchase order sent by you, by email or with reference to a quote, is a binding offer to buy.
- A contract is concluded only when we send a written order confirmation (email is sufficient) or, failing that, when we dispatch the goods. The order confirmation determines the parts, part numbers, quantities and conditions that apply.
- Changes and cancellations after confirmation require our written agreement.
4. Product descriptions, quality tiers and compatibility
Parts are identified by manufacturer part number (for example a Samsung GH82 number) and by the catalogue name in English. You are responsible for checking the part number against the part you intend to replace; two models with the same appearance may use different part numbers, and a wrong choice is not a defect of the goods. The catalogue marks the quality tier of each part, and goods are sold on the terms of the tier shown:
- Service Pack
- A factory-sealed original replacement module from the manufacturer's service channel.
- ASMBLD / Assembled
- An original display module assembled into the frame or chassis; not a factory-sealed service pack.
- RNW / Renewed
- An original screen that has been professionally refurbished or renewed.
- RPLCD
- An original screen whose front glass has been replaced.
- A GRADE
- A graded used original screen; not a new part.
- CHN ORG
- An original panel from the China market channel.
- OLED (soft or hard), Incell / TFT
- Aftermarket panel types; not manufacturer original parts.
Photographs and drawings are illustrative.
5. Quotes, payment and retention of title
- The commercial conditions for each order – currency, delivery terms, payment method and payment terms – are those stated in the individual quote and confirmed in the order confirmation.
- Where prepayment has been agreed, goods are dispatched after receipt of payment. Where a payment term has been granted, it appears in the order confirmation and on the invoice.
- If a payment is late, statutory default interest between businesses under § 456 UGB applies, plus recovery costs under § 458 UGB.
- Set-off against our claims is permitted only with counterclaims that we have acknowledged in writing or that have been established by a court.
- Delivered goods remain our property until the invoice has been paid in full. Until then you may resell them in the ordinary course of business but must not pledge them, and you assign to us the claims arising from such resale.
6. Delivery and transfer of risk
- Goods ship from our stock in Vienna with tracked courier services. Orders are dispatched after order confirmation and, where prepayment has been agreed, after payment has been received. Delivery dates are estimates unless we have expressly confirmed a date as binding.
- We may make partial deliveries where this is reasonable for you; each partial delivery may be invoiced separately.
- Risk of loss or damage passes to you when we hand the goods to the courier or carrier (§ 429 ABGB). If you specify your own carrier or collect the goods, risk passes at handover to that carrier or to you.
- Visible transport damage must be noted on the carrier's delivery record at the time of receipt and reported to us immediately, with photographs of the outer and inner packaging.
- You are responsible for compliance with import rules and for any duties, taxes or fees that arise in the destination country.
7. Inspection and notification of defects (§ 377 UGB)
You must inspect every delivery without delay after receipt and notify us in writing of any defect, shortfall or wrong delivery immediately after it is or should have been discovered. If notification is late, the goods are deemed approved and claims for warranty, damages for the defect itself and mistake as to freedom from defects are lost (§ 377 UGB). Hidden defects must be notified immediately after discovery.
8. Dead-on-arrival (DOA) returns
A part that does not function when first tested may be returned as DOA under the following conditions:
- You report it promptly after delivery, within the period stated on the delivery note, quoting the invoice number, part number and a description of the fault, and we issue a return authorisation (RMA) number before the part is sent back.
- The part is complete and in its original packaging, with the manufacturer's labels, serial stickers and protective films untouched. Service pack seals may be opened for testing but labels must not be removed or overwritten.
- The part shows no sign of installation damage: no bent, torn or creased flex cables, no cracked glass, no pressure marks, no adhesive residue, no missing components.
Accepted DOA returns are replaced with the same part or, if it is no longer available, credited. Parts that fail inspection are returned to you at your cost. Returns without an RMA number cannot be processed.
9. Warranty
- We warrant that parts described as Service Pack are factory-sealed original replacement modules from the manufacturer's service channel, and that all goods conform to their catalogue description and quality tier at the time risk passes.
- Between businesses the statutory warranty under §§ 922 ff ABGB is modified as follows: the warranty period is the period stated in your quotation and order confirmation, running from delivery; the presumption of § 924 ABGB that a defect existed at delivery is excluded; we may choose between repair and replacement first, and the remedies of reduction (Preisminderung) or rescission of the contract (Wandlung) are available only if both fail or are refused.
- The warranty does not cover damage caused by improper installation, electrostatic discharge, mechanical stress, moisture, modification or repair attempts by third parties, or use outside the device the part is intended for.
- Claims for recourse under § 933b ABGB are excluded to the extent the law allows.
10. Liability
We are liable for damage only in cases of intent or gross negligence; liability for slight negligence is excluded, except for personal injury. Liability for indirect loss, loss of profit, loss of data, interruption of business and claims of your customers is excluded to the extent permitted by law. Where liability exists, it is limited to the invoice value of the delivery concerned. Claims under the Product Liability Act (PHG) remain unaffected. You must prove gross negligence.
11. Returns other than DOA
Correctly delivered goods are taken back only by prior written agreement. Opened aftermarket panels, parts ordered specially for you and parts whose packaging or labels have been damaged cannot be returned.
12. Trademarks and independence
Samsung, Huawei, Xiaomi, Apple, iPhone, Google, Motorola, Oppo, Realme, OnePlus and other brand names in the catalogue are trademarks of their respective owners. They are used solely to identify the device a part fits. We are an independent trader and are not an authorised distributor, agent or service partner of any of these manufacturers unless we state so in writing.
13. Export control
You are responsible for observing export and sanctions rules that apply to onward sales of the goods. We may refuse or cancel an order if its fulfilment would breach Austrian, EU or other applicable export regulations.
14. Data protection
Personal data is processed as described in our Privacy Policy on this website.
15. Governing law, place of performance, venue
- Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-law rules of private international law.
- Place of performance for delivery and payment is our registered office in 1230 Wien, Austria.
- For all disputes arising from or in connection with a contract under these terms, the court with subject-matter jurisdiction in Vienna, Austria, has exclusive jurisdiction. We may also bring claims against you at your general place of jurisdiction.
16. Final provisions
If a provision of these terms is or becomes invalid, the remaining provisions remain in force and the invalid provision is replaced by the valid rule that comes closest to its commercial purpose. Amendments and side agreements must be made in writing; this also applies to the waiver of the written-form requirement. These terms are issued in English. Version: 1 October 2026.
